What the Section 137 Bond Does
Irish company law generally requires at least one EEA-resident director. The requirement does not apply while the company holds a prescribed bond in force with EUR25,000 of cover for specified company and tax-law fines and penalties.
The EUR25,000 figure is the prescribed cover, not the price paid by the customer and not cash deposited into the company. The StartCompany.ie package price includes the two-year bond service listed in its scope.
Who Does Not Automatically Need This Package?
A non-Irish founder does not automatically need the bond. If at least one genuine full director resides in an EEA member state, the company may satisfy the director-residence requirement without it.
Citizenship and residence are different. An Irish citizen living outside the EEA does not meet the rule merely because of nationality, while a non-Irish person genuinely resident in the EEA may meet it.
